Evaluation of the European Cosmetic Products Regulation

THE EU COSMETIC REGULATION IS BEING REVIEWED!

The Cosmetic Products Regulation applies to all cosmetic products made available on the EU market.

Its main objective is to create a unified legal framework across the EU in order to:

  • protect consumer health by ensuring that all cosmetics meet strict safety requirements before being placed on the market
  • ensure the functioning of the internal market for cosmetic products.

The CPR impacts manufacturers, importers, distributors and consumers by ensuring that all cosmetic products in the EU are safe for use and that the rules for selling them are consistent across countries.

This first evaluation of the CPR is being carried out 10 years after the Regulation became fully applicable.

It is expected to provide evidence of:

  1. how the Regulation has been applied,
  2. whether it has delivered on its objectives, and
  3. whether it remains fit for purpose, including for the green and digital transitions and the external and internal competitiveness of EU businesses, in the light of current developments.

This initiative will assess whether the rules are working as intended.

The evaluation will investigate, among other things, the current scope of the Regulation, the definitions used, the application of the generic risk approach to ingredients with potentially higher risk for human health, and labelling provisions, as well the main trends in international trade and the external competitiveness of the EU industry. It will also examine whether the CPR is fit to support and enable international convergence with other jurisdictions. It will explore areas for improvement, including any untapped potential for simplification and burden reduction, and will help the Commission determine whether revision of the Regulation is needed.

The period covered by the evaluation will be from 2013 (when the CPR started to apply in its entirety) until 2024. In that period, 50 amendments4 of the Annexes to the Regulation were made, plus 11 corrections and one amendment modifying Article 2 of the CPR.
